Reservations & Cancellation policies:
1. Cancellation by the guests
Reservation
initial Deposit is Non-refundable. In case of cancellation, non-show or early
departure equals 100% accommodation charge.
2. Cancellation or Alterations by
owner
The
Agent is not allowed to cancel the reservation or provide alternative
accommodation to the guest, unless the property is proven not functional and
safe to be used by the end guests. In that case the Agent will need to refund
immediately any deposit received. A cancellation can only be accepted in
writing.
3. Maximum occupancy
The
maximum number of guests is limited to 16 persons. Guest must present at least
one valid passport.
4. Number of guests - Subletting
Only
those persons stipulated on the tenancy agreement may overnight in the
property. Subletting and/or reassignment are strictly prohibited. The number of
guests must not exceed the maximum number indicated in the tenancy agreement.
Should the agent and/or the owner and/or the landlord find that more than the
specified number of guests is occupying the property he will be entitled to ask
the clients to vacate the property immediately without any compensation or
refund.
5. Arrivals & Departures time
Check-in
time is 15:00. Checkout time is 11:00. We cannot guarantee early check-ins or
late checkouts unless confirmed by us in advance.
6. Property Damage
The
guest who signs the tenancy agreement is responsible and liable for the correct
and decent behavior of his party. Guests are responsible for any loss or damage
caused to the property or its contents and is required to report any damage to
the agent and to bear the cost of repair or replacement. The property should be
left in good repair, it will be thoroughly examined, and an inventory taken on
your departure, and if it is not left in a suitable condition, it may be
necessary to charge you the guest for costs to cover extra cleaning, repairs,
or replacements. We also recommend you inspect the villa on arrival to ensure
that it is in order. Should guests behave disrespectfully towards the property
and its contents, the owner and/or agent reserve the right to ask all guests to
vacate the property immediately without any compensation or refund.
7. Entertaining at the property
The
guest agrees to allow the agent or his authorized representative or any
representative of the property owner, access the property at any reasonable and
mutually convenient time during his stay to check the property for the sole
purpose of essential repairs and/or maintenance in order to ensure that the
guest’s comfort will remain at optimum level.
8. Neighbors
Even
though the guest is on holiday, the neighbors may not be and on rare occasions
building work might commence without any prior warning near the property.
Whilst the agent has no control over this, if advised, he will endeavour to
intervene to halt it or postpone it for the duration of the rental period.
Naturally, if the agent is made aware of any nearby building work, he will
always try to advise the guest as early as possible in advance of his
holiday.
9. Guest Injury Disclaimer
The
property owner, agent and any representatives do not accept any responsibility
or liability for acts of omission of third parties which may prevent or disrupt
the booking. The contract exists between the agent and the guest and is limited
to the rental of the property and the associated services (if any) only as
stated under: Services Included in the Price (if any). No liability can be
accepted by the property or agent for any injury, illness, death, loss, or
damage caused to the guests or to a member of the guest’s party and likewise to
any incidental visitors, arising out of or in connection with the use of the
rental property, swimming pool, play areas or all kind of facilities. The use
of these facilities is at the guest’s own risk. The property owner and agent
will not be liable for any damage and losses as a result of burglary or
external intervention. Children are not allowed unattended around the property
at all times. The agent and the property owner rent this property as bare house
and therefore assume no responsibility for accidents, injuries, death, or loss
of to swimming pool, Jacuzzi (where applicable), including consequential
damages from the rental and use of the property such as but not limited. By
signing this agreement, the guest and all members of his party waive any future
claim against the property owner & agent and any representatives in case
any such event occurs.
10. Insurances
It
is highly advised that your party is covered by travel insurance including
coverage against trip cancellation, etc. and against personal injury. The
appropriate coverage should be purchased at the time of the booking. Please
contact your travel agent, travel consultant or insurance broker from your
country of residence about this. The guest is responsible for his third-party
liability, health, and medical repatriation insurances. The property owner and
agent will neither offer such insurances nor shall be held liable for the
absence of such insurances. All travelers are advised to have a medical plan
that will cover any medical & travel expenses in Mexico. In case of
sickness or injury, the agent will do his best to have the patient reach
professional medical assistance, the soonest possible. If a member of the party
has any serious chronic condition, including severe allergies, the guest is
obliged to inform the agent in advance. In any case all guests are advised to
bring ample supplies of the medications they normally need or take, because it
may be difficult to find on location.
11. General Complaints
If
there are any problems with the property or if the guest has any cause for
complaint during the rental period, he must inform the agent immediately. The
guest is obliged to give to the agent the necessary time to resolve the
problem. If the problem is not resolved, the guest must follow up the complaint
in writing to the agent within 24 hours. Until the agent is fully aware of the
problem or complaint, he cannot begin to resolve it. Most of the problems can
be dealt quickly. If the problem has not been reported in detail as urgent or
received at the end of the rental period, the agent cannot accept any relevant
claims or complaints. The agent cannot exclude the possibility that the
property can present minor inconveniences due to the special nature of its
architecture, the personal taste of the owner or the local traditions in the
area; In this case the agent shall try to rectify or change whatever is
possible, but he cannot accept any responsibility.
12. Property Descriptions / Minor
Modifications
The
agent or property personnel (if any), in their capacity as such frequently
visit and check thoroughly the property. The descriptions and the property
photographs appearing on the listings are accurate and have been prepared in
good faith. The agent declines all responsibility for any minor modifications
made by the owner recently without his knowledge. Please note, that the
information, photographs and/or video on the website are intended to avail to
the potential guest a general overall impression of the standard of the
property. Some minor aspects of the property may have changed by the time that
the guest will arrive at the property, for example furniture items may have
been added or removed. The agent cannot accept any liability if this situation
should arise. Whilst every effort is made to ensure and verify the accuracy of
the specific information, regrettably errors may occasionally occur.
13. Removal of Property
Guest(s)
agrees not to remove or alter in any way the Owner's property. Any removal or
alteration of Owner's property without permission shall constitute a violation
of this agreement. Guest (s) shall keep the property and all furnishings in
good order and only use appliances for their intended use.
14. Garbage
Any
garbage must be stowed in the proper garbage or recycling receptacle, located
nearby the property.
15. Electricity / Water Shortages
The
agent kindly asks you as guest to use water sparingly, especially during the
summer months. Electricity and water shortages may take place by the State
Organization in some areas and while the property agent will do everything in
his power to re-establish supply or remedy the situation, he cannot be held
responsible for the inconvenience that such shortages may create.
16. Tap Water
The
tap water is not drinkable in Tulum; please use bottled water. The guests
should inform their party and visitors not to drink the tap water at all
times.
17. Septic System
The
septic is very effective; however, it will clog up if improper material is
flushed. DO NOT FLUSH anything in the toilet, including toilet paper. No
feminine products should be flushed at anytime.
18. Children
Children
are welcome. Please notify us at the time of booking if there will be any
children in your party and their ages. However, they are not allowed in the
Swimming pools or in external spaces, unless properly attended by adults.
19. Pets
Not
accepted, however if you would like to bring 1, please check with us.
20. Smoking
Smoking
is not allowed in any inside area of the house as this is a non-smoking
house.
21. Photography
Photographs
taken at the property cannot be used or sold for profit without the written
authorization of the owner and/or the Agent.
22. Reductions
No
reductions or credit notes will be given under circumstances amounting to
'Force Majeure'. ln the above, 'Force Majeure' means war, threat of war, riot,
civil strike, industrial dispute, terrorist activity, natural or nuclear
disaster, fire, airline failure, and adverse weather conditions or temporary
pest problems at and around the Villa or any other event, situation, incident,
and natural causes outside our control.
23. Valuables
Valuables
left at the property are at the risk of the guest. The owner, the Agent and the
property staff cannot be held responsible for their loss or misplacement. No
responsibility is accepted for any loss of personal items while staying in the
property or after departure.
24. Events - Parties
The
Guest agrees to occupy and/or use the property in such a manner so as not to
disturb the peace of the neighbors especially during off hours (14:30-18:00 and
23:00-8:00) or breach any and all applicable local legislation. Parties and any
type of event are strictly forbidden. Should the Guest makes an unauthorized
use of the property, the Landlord has the right to ask all guests to evacuate
the property immediately without further notice, without any compensation or
refund. In this case the security deposit will be fully forfeited until all
applicable claims are fully settled with the property owner & Landlord
and/or their authorized representative. In case the guests disturb neighbors
with Music and the police gets involved after the neighbours’ complaints,
neither the Landlord or the property owner will be held responsible for any
kind of penalty addressed to the guests. The guests are liable to pay any
direct or indirect damages caused for any violation of the above even in the
case the total amount exceeds the security deposit.
25. Security Deposit
The
amount stipulated at the Table above is paid in order to cover the cost of any
damage to the property or its contents during the term of rental. Any existing
damages must be reported to the Agent upon check in and pictures of the damages
should be available. In case no damages apply after guests check out, the
security deposit should be returned by the Agent to the Guest in full within 14
days but not earlier than 3 days after Guest’s check out. In case of damages,
the respective replacements / maintenance receipts of the expenses need to be
furnished by the Agent to the Guest. Upon the occurrence of such damages, Guest
shall be obligated to release the corresponding amount within 10 days of
provision of the above-mentioned receipts. In the event that the amount above
(security deposit) does not cover the damage, (for example of items of
extremely high value that may be in the Property (antiques, paintings, carpets
etc.)) Guest is liable for the full damage and undertakes to fully compensate the
Agent and/or the owner.
26. Contract / Payment
By
paying the booking amount or part of it, the contract becomes effective, and
both the broker and the Guest automatically agrees to all the above terms and
conditions. Whatever is written in the present contract is all that has been
agreed between the contractual parties and supersedes any other contract of
previous date and both contractual parties agree that there is neither other
valid oral nor written agreement in any form for the specific rental booking.
27. Governing Law / Jurisdiction
This
Agreement and its subject matter shall be governed and interpreted in
accordance with the laws of Greece. Any dispute between the Parties whether
resulting from a claim in contract, tort or otherwise, or any other claim or
controversy which may arise out of or in connection with this Agreement or the
application, implementation, validity, breach or termination of this Agreement,
any provision thereof or any agreement concluded in pursuance to this Agreement
shall be finally and exclusively settled by the courts of Greece.
By
accepting this agreement, the guest and all members of his party confirm that
they have legally entered Greece for vacation reasons only and have the legal
documents to prove it upon any such kind of request by the authorities. In the
opposite case, the tenancy agreement is immediately considered as cancelled and
payment is forfeited in full.
28. Personal Data Protection
Agent
is fully compliant with the provisions of Regulation (EU) 2016/679 of the
European Parliament and of the Council of 27 April 2016 (General Data
Protection Regulation). Agent acts as a data controller solely for personal
data that Guest has previously provided expressly for this rental and Guest
grants the explicit consent to their use. In processing the aforementioned
personal data, Agent proceeds to their storage for the filling of the arrival
and departure list of this tourist accommodation, in accordance with the local
legislation. Agent guarantees that it will not transmit, notify, concede, etc.
any personal data to third parties for any purpose or use. Personal data may be
disclosed to public bodies and / or judicial authorities within their
competence, only when it is necessary for compliance with a legal
obligation.
